GoRaleigh Access 2017 Complementary ADA Paratransit Plan

The Americans with Disabilities Act regulations require GoRaleigh, as a public entity that operates a fixed-route system, to provide complementary paratransit services to individuals with disabilities (that is, service that is comparable to the level of service provided to individuals without disabilities who use the fixed-route system). GoRaleigh provides these services and complies with the act, including all stipulations exhibited in 49 Code of Federal Regulations 37.139.

One of the stipulations requires GoRaleigh to obtain the following endorsement or certification from the metropolitan planning organization:

                     In urbanized areas, certification by the Metropolitan Planning Organization (MPO) that it has reviewed the plan and that the plan is in conformance with the transportation plan developed under the Federal Transit/Federal Highway Administration’s joint planning regulation ( 49 <https://www.law.cornell.edu/cfr/text/49> CFR part 613 <https://www.law.cornell.edu/cfr/text/49/part-613> and 23 <https://www.law.cornell.edu/cfr/text/49/part-23> CFR part 450).

GoRaleigh received authorization from the Raleigh Transit Authority when the plan was adopted June 21, 2017. GoRaleigh brings its ADA complementary paratransit plan before the Capital Area Metropolitan Planning Organization (CAMPO) to also receive its endorsement.

 GoRaleigh coordinates its ADA services seamlessly with GoTriangle, GoCary, and GoDurham. GoRaleigh’s ADA paratransit services meet the six service criteria enumerated in Section 223 of the Americans with Disabilities Act of 1990.

These criteria include:

                     ADA paratransit service must be available in the same area served by fixed-routes.

                     ADA paratransit service must be available to any ADA-paratransit-eligible persons at any requested time on any particular day during which fixed-route vehicles are operating for the respective ¾-mile radius in response to a request for service made the previous day.

                     ADA paratransit fares must not exceed twice the fare that would be charged to an individual paying full fare for a trip of similar length, at a similar time of day on the fixed-route system.

                     There can be no trip restrictions or priorities based on trip purpose.

                     Service must be made available to eligible persons on a next-day basis.

                     There can be no constraints on the amount of service that is provided to any eligible person. Specifically, there can be no operating practice that significantly limits the availability of service to ADA-paratransit-eligible individuals.

GoRaleigh’s Complementary ADA Plan follows select goals and objectives of Connect 2045, the Metropolitan Transportation Plan for CAMPO including statewide long-range transportation plans.  As required by the Code of Federal Regulations 37.139, CAMPO staff certifies that we have reviewed the plan and the plan is in conformance with the transportation plan. The TCC recommended the approval to certify the GoRaleigh Access Complementary Paratransit ADA plan at their June 7, 2018 meeting.
